On the scale of file sharing and the mentality of pirates there will be some as you put it 'elite hackers' will get through, further from that they will create easier ways to access free software without detection or through loop holes. The more laws that come in to protect IP the harder it will be for the end user to break the law.
The only way it would be certain to stop would be the 'surf-by-license' thing you mentioned. I believe there are plans to create such an internet parallel to what we know as the internet, in which you disclose everything about the real you, no avatars or usernames and you sign up with your passport/bill/drivers license. No one is going to offer illegal software if their full name and address are found that easily.
