More proof of the complete ignorance of the Brexiteers regarding the workings of the EU.
Well, this comes as no surprise. Remember how during the EU referendum, the Brexiteers complained about unelected judges in Brussels? Of course judges are unelected! You don't elect the judiciary, the same way you don't elect doctors.
(Yeah, I know the Americans do it, but they're just crazy.)
