You could fool people before that. Animals are perfectly capable of fooling other animals (and people - if you have ever had a dog, you know what I mean). But as the ability to lie evolves, so does, necessarily, the ability to detect lies. (Although, now I think about it, people seem to be perfectly willing to let themselves be fooled if the lies come from the "right" source, but that's another story.)
